LAS LEGAL LASKOWSKI KNAP SPÓŁKA KOMANDYTOWO-AKCYJNA LAS LEGAL LASKOWSKI KNAP SPÓŁKA KOMANDYTOWO-AKCYJNA (hereinafter: "LAS") is the controller of personal data obtained in the course of its activities. LAS processes personal data:

  1. in order to inform about LAS activities and the effectiveness of information activities in this regard, in particular by maintaining the website and profile on Twitter, Facebook, LinkedIn, based on the legitimate interest of LAS to increase market awareness of LAS services and evaluation of activities carried out in this regard;
  2. for the purpose of establishing and maintaining business relationships by collecting information about individuals with whom LAS representatives meet and with whom they exchange information, based on LAS's legitimate interest in increasing market awareness of LAS services and obtaining information to offer LAS services;
  3. for the purpose of providing services that are the subject of LAS's activities, in particular for the purpose of concluding and performing a contract for such services, on the basis of a contract for the provision of services - if the subject of the personal data is a party to it, and on the basis of LAS's legitimate interest in maintaining and developing its business activities - if a party to the contract is not an individual;
  4. for the purpose of entering into and performing other contracts to which LAS is a party, based on LAS's legitimate interest in ensuring that LAS can conduct its business;
  5. for the purpose of recruitment, on the basis of activities aimed at concluding a contract - if the recruitment concerns the conclusion of a civil law contract, and on the basis of the law and the person's consent - if the recruitment concerns the establishment of an employment relationship, and in both cases LAS additionally processes the personal data of candidates on the basis of LAS's legitimate interest consisting in the need to assess the candidate's qualifications and establish possible terms of cooperation;
  6. for the purpose of documenting the acquisition of rights or property, based on LAS's legitimate interest in defending and exercising LAS's rights and powers;
  7. for the purpose of establishing or asserting possible claims or defending against claims made against LAS, on the basis of LAS's legitimate interests consisting, in particular, in maintaining its business activities, ensuring the possibility of exercising one's rights and protecting the good name of LAS;
  8. for the purpose of fulfilling obligations under the law, on the basis of the relevant regulations, in particular, regulating the obligations and operation of LAS as an employer, principal, entity seeking employees and collaborators, taxpayer, payer of social security contributions and entrepreneur.

Recipients of personal data processed by LAS may be LAS service providers, in particular, entities providing accounting services for LAS, providing IT support, operation and maintenance of servers, operation and maintenance of licensed IT systems, support in the organization of LAS information activities, postal operators, couriers or recruitment agencies.

LAS processes personal data to the extent and for the duration justified by the purpose of the processing.

The purpose of the processing also determines the period for which personal data is kept. For example:

  • personal data processed for the purpose of concluding and performing a contract shall be processed and stored for the duration of the contract and after its expiration - for the period and to the extent necessary to document a business event with tax consequences and also - in justified cases - for the period necessary to protect against or assert claims related to the contract;
    if on the basis of a contract LAS acquired the right - for the period in which the right is vested in LAS, which may mean that such data is kept forever or for a very long period of time (e.g., in the case of acquisition of author's economic rights).

Individuals whose data is processed by LAS may have the following rights:

  1. right of access to data;
  2. The right to rectify the data, erase it or restrict its processing;
  3. The right to object to data processing;
  4. The right to data portability;
  5. The right to withdraw consent to data processing, which withdrawal, however, does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal;
  6. The right to file a complaint with the supervisory authority.

It is not possible in every case to effectively exercise the rights listed above. For example - the right to erasure cannot be exercised if the data will still be needed for the performance of legal obligations or necessary to establish, assert or defend claims. The provision of personal data processed by LAS may be voluntary (as in the case of the provision of additional data by a job candidate or the provision of information useful for the performance of the provision of services), or it may result from statutory requirements (as in the case of the provision of data necessary for the fulfillment of tax obligations or obligations of a payer of social security contributions, or data that an employer requires from a job candidate in accordance with the law). Failure to provide data in cases where it is necessary for the fulfillment of statutory obligations or basic legitimate interests of LAS may make it impossible to perform a given task or conclude a contract. LAS does not make decisions by automated means, in particular, it does not carry out profiling of persons whose data it processes.
